Some More Poems

`Woman Betrayed’ is in the realm of social realism. It is about the `lived lives’ of the urban educated Indian women, who, in the urban Indian milieu, can ill afford to be themselves, and `vulnerability’, a feminine virtue, becomes a curse for them, which is a very sad day for civilization and is a travesty of being.  

`The Call Of Honour’ is about the most misunderstood country Russia, which, whatever the world might say, was destined to play a colossus of a role in the face of the Frankenstein  of the mania of the Nazi sweep. No other country, except Russia, has had the courage to play out imagination suffused with history. It is overwhelmingly elevating to walk the corridors of the `Victory Park’ in Moscow, where millions of tear drops hang in the memory of those who gave their lives for history to take a turn. So history was made. It did not `happen’.

The poem `In a Cityscape’ celebrates the `cityscape’ as a citadel of freedoms, that a modern civilization bestows upon humans,and warns against the squandering of the riches earned in the course of a civilizational journey, the `squandering’ which may `happen’ when `democracy’ is lived only by its faults and blunders, and words like justice and equality are thoroughly misunderstood, much to the detriment of beauty and truth.

Both sides of Indus , they will not let you be

No Woman No Cry

A day in the life of a woman lawyer in India
I am beginning this blog with the said song because I am mighty sad as I narrate here one of the days in the Indian Court where along with the extreme delay in the matters of justice , I face extreme hypocrisy of the system of governance ( justice) and most blatant mutilation of my being as a woman and that my work has no blessing , as I do not get justice in my matters even when I am on the side of impeccable truth and even when I do not absent myself from court hearings- so the result is that `I give an impression that I do not have it in me to get justice for people and that I am a thoroughly incompetent and a useless law professional’ – May I say that I do not practice law to get accolades or awards but only to see that rare smile of solace on the faces of people who get that rare justice and rarely in the right time- But I have been failing in my pursuits of getting justice in the right time- the justice system has been hoodwinking me – The case here is that of a SME- a small and middle enterprise that has been at the receiving end of injustice – it is in the category of SME and is a garment manufacturer (a garment manufacturer has a very thankless job even though a manufacturer is a prime mover in growth and gives employment to the skilled and the semi-skilled and many a times to those with very scanty skills – what this means for a country like India is known to most –this means giving livelihood to those who would have been destitute and wanderers in the pursuit of two square meals or a cloth to wrap around or to aspire to have a family to be human) – And one might argue that the SME owner might be a rank profiteer – far from it ! – the SME owner is the one who is pressurized under the burden of bank-overdrafts, and is on tenterhooks at each manufacturing cycle in order to procure fabric and raw-material for production – and this gets totally sour and unpalatable when the manufacturer is not paid even after the retailer has sold out the goods at the retail counters and earned profit. And the law does not `really speaking’ come to the rescue of the manufacturer because the courts do not see any urgency in the manufacturer getting his money – and the whole cycle of poverty that the manufacturer addresses but in the end has his coffers empty. It is in this context and situation that a woman lawyer goes from Delhi Pathankot – she is armed with a decree of money from the Delhi Court and has to get it executed from the Pathankot-Punjab Court- so she files an execution petition ( to get the money decree executed) in the Pathankot District Court whose name was Kulbhushan Kumar-

A Delhi lawyer goes to District Court Pathankot, Punjab- The judge was Sh. Kulbhushan Kumar, Additional District Judge, Pathankot, Punjab. UID No. PB0170.
I had been going to District Court Pathankot to get a money decree executed – That is the Delhi Court had ordered that the money due towards the petitioner be paid to him. After years ( 5 years) of having gone to Pathankot to get the particular money-decree executed and having got all orders in my favour , the decree stood unexecuted and the money stranded . Then came a judge in District Court Pathankot

The order of Additional District Judge (ADJ) Kulbhushan Kumar reeks of misuse of power, misogyny, male chauvinism, gender-bias and is full of blatant lies, injustice, unfairness and totalitarian attitude and has caused me, Pratibha Chopra, mental and physical trauma, has been an affront to my dignity-life and liberty- and was a modus operandi that he resorted to because he had no other alternative but to project his arbitrary and highhanded behavior on me while he was the one who behaved in a misogynist and gender-biased manner in order to save his skin from contempt of court proceedings which could be moved against him by all means because he was in contempt of his own court in terms of defying his predecessor’s orders and also in contempt of the orders of the Punjab and Haryana High Court at Chandigarh which he had been defying without any fear of the Rule of Law and in complete travesty of the Judiciary as in the definition of State under Article 12 along with his unabashed gender bias and anti-women terminology and fervor wherein he accused me of- `taking undue advantage of being a woman’, `shouting in the court’ and `showing him fingers’ thrice in the open court’- whereas the fact is that his court did not execute any order when all orders were in my favour- so by this he violated the laws of natural justice in not giving me an opportunity to be heard and then he became a judge in his own case . He used the word `hyper’ against me, thus extending his gender-bias in terms of denigrating my feminine persona which is the rightful space of a woman. He falsely accused me of using derogatory language whereas I did not use a single word that was out of the court’s decorum. I only urged him to further the execution and that he should ask the judgment debtor to pay as per the orders of his predecessor to which he answered why the judgment debtor should pay when I had got arrest orders against him. To which I said that the arrest orders (coercive steps) were vacated by the High Court long back on 06.11.2019 and the High Court had ordered that the executing court was at liberty to proceed with the execution. And I further said that he should write in his orders what he said that why he should ask the judgment debtor to pay when I had got an arrest warrant issued against the Judgment Debtor- because what he said was against the law and also against the orders of the courts, both the High Court and the District Court Pathankot. Then I said that since he refused to follow the orders of the courts to execute decree and refused to write the reasons in his order, I would file a contempt of court against him- this was my outrage against injustice as the money decree was being stalled by him and the judgment debtor in rank unfairness even when I had been going to Pathankot for many years even in rough weather conditions and discomfort and also via Jammu (when there were no available fights to and from Pathankot) during the abrogation of Article 370 when the law and order was in a fluid state in Jammu and Kashmir as it was, practically speaking neither a State nor a Union Territory.

It is needless to say that he has defied my right to Life and Liberty read with Art. 14 in his non egalitarian and autumnally patriarchal bias against a woman lawyer by indulging a male lawyer against me even when this male lawyer was on behalf of the wrong-doing judgment-debtor who was delaying and obstructing the decree in favour of the decree-holder in absolute defiance of all the orders of the High Court of Punjab and Haryana at Chandigarh and District Court Pathankot and in the complete Contempt of Court by seeking time for a Civil Revision in the High Court for almost 5 years upto the last quarter of 2023 whereas he filed a Civil Revision in the High Court in the year 2019. The judgment debtor has been taking advantage of his own wrong and the ADJ has been, practically speaking, allowing him the time to file civil revision which he had already filed in 2019 on 1/11/2019 and the predecessor judge had refused time to file civil revision. The judgment debtor has all the orders against him. Also ADJ Kulbhushan Kumar has been indulging the opposite party’s lawyer when that lawyer has been passing personal comments on me in his provincial mindset by saying that `since I was from a big city Delhi, I thought myself to be superior,’ to which I said that for me , the whole of India was my own country and that was what a cosmopolitan city like Delhi had taught me.
Defying justice is contempt of court – lowering the dignity of the court and denigrating it- and that is what the ADJ Kulbhushan Kumar’s court has done along with the J D –petitioner. I have been going to Pathankot for many years now just to face disobedience and defiance of the court’s predecessor’s ADJ Sh. Avtar Singh’s orders and that of the High Court’s orders, with each date amounting to the waste of the tax-payer’s money as the court’s time was being wasted and it caused a lot of agony and angst to me and caused mental and physical trauma to me. The Additional District Judge Pathankot , Punjab, did this because he could not brook how a woman could get all orders in her favour following the path of truth and substance of law in all fair and just procedures- he felt threatened and deliberately stalled and obstructed the execution orders- when urged by me that he should follow and execute the orders, his puny ego got offended and he passed misogynist orders against me and taking advantage of his own wrong wrote in his order that I was taking undue advantage of being a woman and was ‘hyper’ and was `dictating’ to him what to write in the order.

If one comes to think of it, what can be the meaning of `taking advantage of being a woman’ ? A woman, we all understand, is different from a man in her femininity and her sexuality- So taking advantage of these means that a woman is getting orders in her favour by her feminine characteristics, putting them to an immoral use and not on merit or truthfulness- and then using her sexuality to make the judge weak so that he should get bogged down – both these are to cast immoral aspersions on the woman’s character and are accusations of the most demeaning and derogatory category and are an affront to her dignity , life and liberty-
And saying that `she showed me fingers thrice in the open court’ means that the woman was indulging in sexual innuendoes- So what does this imply that the woman was using her being on a very bizarre and perverted level to axe the decorum of the court and insinuating some sexual oppression on the judge as if the court was some `wrestling ground’ for a competition in dullness and drudgery , mockery of justice and unfairness and a seat of discrimination.
Furthermore it has become a staple in a country that a woman should be lynched and abused if she speaks in a tone higher than a conservative misogynist cast allows.

( That in a novel – `The Trial’ ( written in German and published posthumously) by Franz Kafka, Josef K’s trial takes place in an unnamed city. It so goes -Josef K who has turned thirty years old, is arrested at his apartment, without having done anything wrong, by two agents from an unspecified government agency for an unnamed crime – the crime neither revealed to him nor the reader.
So Josef K’s struggle begins against the mindless bureaucracy of the law in which he is caught and this is akin to an ordinary Indian’s struggle against an unreasoning and unreasonable authority – this is an anticipation of totalitarianism. )

On 18. 08.2023, at District Court Pathankot, I filed a written reply to all the two applications of the judgment debtor, the applications were filed by the JD to obstruct justice once again- my reply , in brief , said that the applications were infructuous and misleading as the judgment debtor was seeking time in 2023 ( in fact he had been misleading the court since 2019 to seek time for civil revision even in 2023 which he had already filed in 2019) for the civil revision that he had already filed in 2019 on 1/11/2019 and other applications had subject matters that were already pressed in the High Court civil revision petition of the judgment debtor and thus the subject matters were before the High Court , thus there was no need to reply to them , they being infructuous and misleading.
I had gone for a hearing in the Chandigarh High Court, (and all throughout the hearing the judgment debtor was absent) and had read out the order of 06/11/2019 wherein the Hon’ble High Court had ordered that the coercive steps not be taken against the judgment debtor(thus the arrest order was stayed) but execution be proceeded with as per law. I further said that I had informed the Hon’ble High Court that the JD had misled the District Court Pathankot by relentlessly praying for `time to file the civil revision’ even after having filed the civil revision on 1/11/2019 and that he had filed the civil revision on 1/11/2019 but I (the lawyer of the Decree Holder) got the copy of the Civil Revision petition only on 28/03/2023- furthermore the petitioner was repeating himself by disobeying the District Court’s orders and obstructing the course of justice and thus doing the very same thing again for which imprisonment was ordered against him – to which the Hon’ble Judge of the High Court had asked whether his ( J. D’s /petitioner’s) property had been attached, and I answered `no’ and informed the court that many notices were given ( I read out the dates) to the JD/petitioner `to come present in the court’ to show his assets and prove to the court as to how the JD would satisfy the decree that had been passed in favour of the Decree Holder and against the judgment debtor , but the judgment-debtor disobeyed which was the reason for passing the orders of imprisonment (warrants of arrest against him) . The Hon’ble High Court was rather shocked how the execution was being stalled as I told the Court, the Hon’ble High Court said that if the petitioner /JD did not appear on the next date of hearing, the stay against the imprisonment would be vacated and of course the arguments would be heard in any case- it is pertinent to inform that the judgment debtor /petitioner was not present in the High Court hearing too.
The Additional District Judge Pathankot could not tolerate when I told him the truth about the judgment debtor wherein I read the order of 06.11.2019.
First he comes and says that he wants to file a civil revision (which he had already filed on 1/11/2019 but conceals from the court) which the judge refuses.
Then he comes with an order under the civil revision ( filed on 1/11/2019) in the High Court which put a stay on his arrest orders-arrest warrant.
Thereafter the judge, according to the order of the High Court recalls the warrant of arrest and imprisonment and orders the judgment debtor to pay to the Decree-Holder.
The judgment debtor again disobeys the orders of payment and is still disobeying the orders.

This is a blatant misuse of power, despotic and lying behavior, misogyny, gender-bias, male-chauvinism, provocation, and obstruction and stalling of law, on the part of ADJ Kulbhushan Kumar be taken very seriously and ,acted upon and it be reported to the appropriate authorities because he has travestied law and lowered the bar of the judiciary –the bar and the bench and has violated my dignity, rights of Natural Justice and the rights under articles 21 and 14, 19 of the Constitution of India and the Right to Justice. Women who travel to State District Courts face the above said affront to their dignity, self-respect and they are not safe at work in such courts.
